Looking for a little insurance before trusting your developer with all of the source code to your software program? Software escrow is your answer to safely protecting your important source code should your developer decide to leave or go bankrupt or if you choose to sell your source code to another company.
It is very common to trust your investment to a third party who can hold onto your source code should the relationship between you and your software developer take a turn. It is a safeguard in case you want to entrust another developer to change or fix bugs in the future.
As part of an agreement with you and the developer, once your software is written- a copy of it will be given to a software escrow agent, a neutral third party. The agreement would specify that the software escrow agent would be allowed to release the source code to you under certain conditions only. The developer’s copy rights are then protected unless the conditions are breeched, something happens where wither you or the developer should part ways and the software escrow agent is then able to give you back your original code. It is a safe haven for your code should you decide to sell it to another person or company.
